Terms and Conditions

Mediation terms and conditions for renting property via iRooms and Houses Rotterdam

Registration offers no guarantee of finding a suitable property. Rooms and Houses is dependent on the supply of property and allocation by landlords.

Definitions: Rooms and Houses: iRooms and Houses Rotterdam, Boompjes 40, 3011 XB Rotterdam, The Netherlands.

Client: any natural person or legal entity which tasks Rooms and Houses with mediating in the rental of one or more properties.

Rent: the monthly sum payable to the landlord, including any charges for carpets/curtains and furniture and/or service costs and/or other components of the total rental sum.

Article 1: The contract

1.1 The contract is concluded via signature of the Rooms and Houses registration form which has been completed truthfully or by the client sending an Rooms and Houses registration form which has been completed truthfully online at www.roomsandhouses.nl via the ‘expat/corporate housing portal’.

1.2 Clients are obliged to produce valid ID and recent income details on registration. Any documentation provided by clients will be stored in Rooms and Houses’s archive and will not be passed on to third parties (not including landlords/house agencies). Rooms and Houses reserves the right to destroy any data provided by the client.

1.3 Any offers made by Rooms and Houses, whether in writing, by E-mail, online or oral, are non-binding. Clients may not derive any rights from these.

Article 2: Registration

2.1  Clients who register via online registration via the ‘expat/corporate housing portal’ have to pay a fee of 25 euros, but clients must meet the income criteria or have a guarantor.

2.2 Registration is valid for six months.

2.3 Any overheads incurred by Rooms and Houses relating to fulfilling this assignment are for the account of Rooms and Houses.

2.4 The client’s allocated registration number cannot be transferred to any other natural person and/or legal entity.

Article 3: Assignment

3.1 Rooms and Houses’s assignment, i.e. mediating in the rental of suitable residential or commercial premises, shall commence on receipt of the signed and truthfully-completed registration form, production of valid ID, recent income details and/or employer’s statement and/or accountant’s certificate.

3.2 Rooms and Houses’s assignment comprises issuing advice and accompanying the client on visits to properties, offering potentially suitable properties, negotiation, mediation and delivery of the property rented by the client. In many cases, Rooms and Houses will draw up the tenancy agreement, although it is not obliged to do so.

Article 4: Payment

4.1 If Rooms and Houses is successful in mediating in the rental of one or more properties accepted by the client, the client has to pay Rooms and Houses an agency fee. This agency fee must be paid to Rooms and Houses within 48 hours of signing an acceptance form or a tenancy agreement and comprises: for each property successfully mediated by Rooms and Houses, half month’s rent, i.e. equal to half the month’s rent for the property rented by the client. This agency fee is excluding 21% VAT. If the final agreed rent is lower, the fee owed is equal to half the lowered rent at which the property is to be rented.

4.2 If the property to which the agency fee relates includes utility costs, the agency fee is equal to the rent including these utility costs.

4.3 The sums named in section one of this article are one-off sums owed to Rooms and Houses. This sum last a year, and if client will request another service within this year, the agency fee would be charged at a 25% discount.

4.4 Clients will not be given access to the property successfully mediated by Rooms and Houses until the agency fee has been paid to Rooms and Houses and the first due rent and deposit have been paid. On acceptance of a property offered by Rooms and Houses, clients must sign an acceptance form and/or tenancy agreement. On signature of the acceptance form and/or tenancy agreement, Rooms and Houses is always entitled to the due agency fee of half month’s rent, equal to the half the rent as described in 4.1 and 4.2.

4.5 CAUTION! If a client has accepted a property offered by Rooms and Houses orally or in writing and Rooms and Houses has drawn up the relevant tenancy agreement and/or acceptance form, but the client decides not to rent the previously accepted property and therefore refuses to sign the documents drawn up by Rooms and Houses, the client always owes Rooms and Houses a cancellation fee of 50% of the agency fee originally owed. The client must pay this cancellation fee within 48 hours of the cancellation in cash or by debit card.

4.6 Any invoices for which the payment deadline has expired are passed on to BSR in Tiel. Any additional costs, legal fees and/or non-judicial costs are for the account of the client.

Article 5: Liability

5.1 Rooms and Houses cannot be held liable for the way in which landlords fulfil their obligations and/or for their conduct as a landlord. Clients should always deal directly with the landlord, unless agreed otherwise in writing.

5.2 Any relationship created between Rooms and Houses and the client is subject to Dutch law.

Article 6: General terms and conditions

6.1 Our full terms and conditions apply to all Rooms and Houses’s activities. These terms and conditions have been filed with the Chamber of Commerce in Rotterdam under number 69356025. The client has been given a copy of these terms and conditions.
